Following a long history of disagreements, an interim personal violence order was granted in Milton Local Court on December 1, 2016 protecting Danny Scott Shilling and the victim from one another until allegations were due to be heard in court in January.
However, frayed tempers boiled in a seemingly unprovoked attack during an afternoon dog walk on Friday, January 6.
Shortly after 5pm Shilling was walking his dog along Wallaroy Drive in Burrill Lake, when the victim, his neighbour, was driving along the street and pulled over to send a text message.
The victim heard yelling and shouting coming from outside the car and looked up to see Shilling.
"You f--king c—t,” Shilling said to the victim.
“You're a coward, get out of the car ‘cause I want to fight you."
The victim remained in the drivers seat, the car idling and windows down, and turned his mobile phone onto record.
The 49-year-old continued to scream at the victim saying "Let's go d--khead" and can be seen tying his dog’s lead to a nearby fence.
"Park the car,” Shilling said.
“Your dogs not going to help you.
“Go and park your car.
“You're a f--king coward. You won't even have a go."
The court heard Shilling then kicked his thongs off and ran towards the victim’s car with a clenched fist.
“You're a weak c—t,” Shilling yelled as he stood at the driver’s side window.
“You've always been a weak c--t.
“You want to have a go don't you?"
"F--k off c--t and leave me alone,” the victim responded.
"You're a weak f--king p-ssy,” Shilling continued.
“Why do you change your hair, your f--king beard all the time?
“‘Cause everybody hates you? And you're always trying to have a f--king go "
Shilling then lunged at the victim through the car window, grabbed his t-shirt and ripped it with his left hand.
“You're a f--king c—k head mate,” the victim said.
Still holding the victim’s t-shirt, Shilling drew his right hand back and clenched his fist.
Believing he was about to be punched, the victim grabbed hold of Shilling’s fist and yelled, "F--k off Danny you piece of sh-t."
Shilling then drew his fist back further and the victim lost his grip.
He punched the victim in the right shoulder, grabbed a hold of the victim by the shoulders and attempted to pull him out of the car.
The victim the accelerated away and drove to Ulladulla Police station to report the incident.
Later that night police attended Shilling’s house and while being cautioned and placed in the police vehicle documents tendered to the court show Shilling said "He's a compensation thief, he's a f--kwit, they're all f--kwits.”
“I tried to pull him out of the car and punch the sh-t out of him.
“I should have flogged him.”
Shilling was placed on an 18-month good behaviour bond and fined $1600 in Milton Local Court.
Following sentencing the victim could be heard yelling “you beauty” as Shilling left the court.
