Shaun McDonald, 30, stole a mechanic’s tool box under the guise of an agreement that he could borrow a friend’s items when he was away.
On November 25, a witness went to his father’s house while his father was away on holidays. Court papers state the witness walked into the laundry and spotted Mr McDonald closing the rear sliding door.
The witness then watched McDonald and a co-accused carrying his father’s tool box out the rear gate.
The pair gave it to a person with whom who they had an outstanding debt. The person later on-sold the tool box.
During his final submission to the court police prosecutor Sergeant Richard Novatin labelled the crime as an opportunistic action by McDonald.
Magistrate Gabriel Fleming told the court McDonald had a “shocking record” before 2013 and that he would expect the court to do something about it if he was the victim of theft.
“From 2013 to 2017 something was going right for you,” Magistrate Fleming said.
The magistrate convicted him and sentenced him to 150 hours of community service “in lieu of jail”.
