The bill is to be introduced to parliament this week by Independent Alex Greenwich, and is supported by Liberal and Labor Party members.

"I think it's absolutely a no-brainer, quite frankly," Ms Hancock said.

"Every other state has this legislation, and so should we.

"These are young women who are vulnerable, frightened or perhaps traumatised.

"Do we want that experience compounded by having potential criminal procedures brought against them or their doctor?

"No."

Mr Ward agreed.

"The reproductive rights of women should not be contained in criminal legislation," he said.

"It is a personal and medical decision, and should not be dealt with under the Crimes Act.

"It's a conscience vote, and I can't in all good conscience vote any way other than yes."

NSW is the only Australian state or territory that has not decriminalised abortion, which still carries a maximum penalty of 10 years imprisonment for women and their doctors.

The proposed legislation would excise abortion from the state's 119-year-old criminal code, and create a healthcare act to regulate the procedure.

The bill allows abortion for women up to 22 weeks pregnant performed by a registered doctor. Women beyond 22 weeks would need the consent of two doctors.
